Remember, when you are using a service provided by EpicServers including but not limited to, Email, Support Ticket/System, Forums, Private, Public, Customer Servers or while using other EpicServer, websites, products and/or services, you may be in a social environment, so please be respectful in the way you communicate, or otherwise socially interact.

Here are the basic rules that you agree to follow when you use, leaseing/renting, participate or otherwise involved with EpicServers services.

EpicServers services are meant for people over the age of 15. If you are under the age of 15, by using EpicServers service(s), you're telling us that you have your parents' or guardians' permission to do so.

If you live outside of Australia, you may be subject to the laws of the country you live in and by using EpicServers service(s), you're telling us that you consent to the laws of Australia and the State Of Victoria, and the governing laws of the country you may currently reside in.

EpicServers will under no circumstance will be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of EpicServers products and/or service(s). Nothing within this Agreement will operate to exclude any liability for death or personal injury arising as result of the negligence of EpicServers as a whole or anybody under it including it’s employees or agents.

ACCEPTABLE USAGE POLICY/TERMS OF USE
This applies to all persons and entities (collectively, "customers," "Users.") using the products and service(s) of EpicServers., ("EpicServers") including Internet service, Game Servers, Dedicated Servers, Server Reselling, Web Hosting, Community, Support. The policy is designed to protect the security, integrity, reliability, and privacy of both the EpicServers network and the products and service(s) EpicServers offers to its customers. EpicServers reserves the right to modify this policy at any time, effective immediately upon posting of the modification. Your use of EpicServers's products and services constitutes your acceptance of the Acceptable Use Policy in effect at the time of your use. You are solely responsible for any and all acts and omissions that occur during or relating to your use of the service, and you agree not to engage in any unacceptable use of the service.

MODIFICATION
EpicServers reserve the right to change any part of this agreement without notice and your use of EpicServers will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement. EpicServers have complete discretion to modify or remove any part of this site without warning or liability arising from such action.

WHAT USES ARE PROHIBITED?
Unacceptable use includes, but is not limited to, any of the following:

1. Posting, transmission, re-transmission, or storing material on or through any of EpicServers products or service(s), if in the sole judgment of EpicServers such posting, transmission, re-transmission or storage is: (a) in violation of any local, state, federal, international, or Australian law or regulation (including rights protected by copyright, trade secret, patent or other intellectual property or similar laws or regulations); (b) threatening or abusive; (c) obscene; (d) indecent; or (e) defamatory.

2. Installation or distribution of "pirated" or other software products that are not appropriately licensed for use or distribution by customer.

3. Resale of EpicServers products and service(s) without the express prior written consent of EpicServers (unless you are an authorized wholesaler or Reseller).

4. Deceptive marketing practices.

5. Actions that restrict or inhibit anyone - whether a customer of EpicServers or otherwise - in his or her use or enjoyment of EpicServers's products and service(s), or that generate excessive network traffic through the use of automated or manual routines that are not related to ordinary personal or business use of Internet services.

6. Introduction of malicious programs into the EpicServers network or servers or other products and service(s) of EpicServers (e.g., viruses, trojan horses and worms).

7. Causing or attempting to cause security breaches or disruptions of Internet communications. Examples of security breaches include but are not limited to accessing data of which the customer is not an intended recipient, or logging into a server or account that the customer is not expressly authorized to access. Examples of disruptions include but are not limited to port scans, flood pings, packet spoofing and forged routing information.

8. Executing any form of network monitoring that will intercept data not intended for the customer.

9. Circumventing user authentication or security of any host, network or account.

10. Interfering with or denying service to any user other than the customer's host (e.g., denial of service attack(DDoS)).

11. Using any program/script/command, or sending messages of any kind, designed to interfere with, or to disable a user's terminal session.

12. Failing to comply with EpicServers's procedures relating to the activities of customers on EpicServers-owned facilities.

13. Furnishing false or incorrect data on the order form contract (electronic or paper) including fraudulent use of credit card numbers or attempting to circumvent or alter the processes or procedures to measure time, bandwidth utilization or other methods to document "use" of Epicservers's products or services.

14. Sending unsolicited mail messages, including the sending of "junk mail" or other advertising material to individuals who did not specifically request such material, who were not previous customers of the customer or with whom the customer does not have an existing business relationship (e.g., E-mail "spam"); or distributing, advertising or promoting software or services that have the primary purpose of encouraging or facilitating unsolicited commercial E-mail or spam.

15. Harassment, whether through language, frequency, or size of messages.

16. Unauthorized use or forging of mail header information.

17. Solicitations of mail or any other E-mail address other than that of the poster's account or service, with the intent to harass or collect replies.

18. Creating or forwarding "chain letters" or other "pyramid schemes" of any type.

19. Use of unsolicited E-mail originating from within the EpicServers network or networks of other Internet Service Providers on behalf of or to advertise any service hosted by EpicServers or connected via the EpicServers network.

20. Exporting, re-exporting, or permitting downloads of any content in violation of the export or import laws of the Australia or without all required approvals, licenses and exemptions.

No failure or delay in exercising or enforcing this policy shall constitute a waiver of the policy or of any other right or remedy. If any provision of this policy is deemed unenforceable due to law or change in law, such a provision shall be disregarded and the balance of the policy shall remain in effect.

ABUSABLE RESOURCES
Upon notification of the existence of an abusable resource (e.g., open news server, unsecured mail relay, or smurf amplifier), the customer shall immediately take all necessary steps to avoid any further abuse of such resource. Any abuse of an open resource that occurs after the customer has received such notification shall be considered a violation of this policy and enforced as such.

ENFORCEMENT
EpicServers may immediately suspend and/or terminate the customer's service for violation of any provision of this policy upon verbal or written notice, which notice may be provided by voicemail or E-mail. Prior to suspension or termination, EpicServers attempts to work with our customers to cure violations of this policy and ensure that there is no re-occurrence; however, EpicServers reserves the right to suspend or terminate based on a first offense.

The Terms of Use constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Use will be effective only if in writing and signed by EpicServers. You may not assign this agreement to any other party (by operation of law or otherwise) without the prior written consent of EpicServers.

This Terms of Use shall bind and insure to the benefit of the successors and permitted assigns of the parties. In the event of a breach of this Terms of Use, the breaching party shall pay to the other party any reasonable attorneys' fees and other costs and expenses incurred by the non-breaching party in connection with the enforcement of any provisions of this Terms of Use.

Modifications to these Terms of Use
If you do not accept this agreement, you are not entitled to use EpicServers products and/or service(s) and will not be granted any further access to it if you do not accept the Terms of Use.

WHAT SHOULD I DO IF I FEEL MY COPYRIGHT HAS BEEN INFRINGED?
If you believe that a user's content has violated your copyright you should provide EpicServers with a "takedown notice" in writing to the e-mail address: abuse@epicservers.net

The "takedown notice" should include the following information:

1. A representative list of content (if more than one).

2. Identification of the copyrighted material used in the content.

3. Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

4. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

5. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

6. Be very specific in your description of the copyright violation, this will make it easier for EpicServers to comply with a legitimate request.

Once the complaint has been verified, EpicServers will remove such content. EpicServers, to extent possible, will alert the user submitting such content and provide them with an opportunity to send a notice to EpicServers to contest the removal.

If you abuse this process, this will be considered a violation of the Terms of Use and EpicServers reserves all its rights to protect EpicServers, its partners, affiliates and users.
